• Jurisdictional Review of Contaminated Site Qualified Persons (QP) Programs Now Complete
  OCETA, on behalf of the CBN, and in conjunction with the Canadian Petroleum Products Institute (CPPI), the Cement Association of Canada, Kilmer Brownfield Equity Fund L.P., and the Canadian Manufacturers and Exporters conducted a Jurisdictional Review of the Contaminated Site Qualified Professionals Programs. The jurisdictional review of the contaminated site QPs provides an overview and analysis of the QP programs currently in place to identify "best practices". The outcomes from this review can be used by government and industry stakeholders in Canada that are developing or redesigning their QP programs.

• Alberta Environment Tier 1 & Tier 2 Guideline Workshop
  February 14, 2008, Grande Prairie, Alberta
  Alberta Environment has consolidated soils and groundwater remediation guidelines from a number of sources (Canadian Council of Ministers of the Environment, Health Canada, and Alberta Environment) into a single, comprehensive, Tier 1 guidance document. A companion Tier 2 guidance document has also been developed that details how Tier 1 guidelines can be modified based on site-specific information. Both guidelines maintain an equivalent level of ecological and human health protection. This workshop is intended to provide a general technical overview of the new Tier 1 and Tier 2 guidance documents, highlighting key regulatory requirements needed for site closure. AENV will be present at the workshops to discuss the regulatory requirements.

National

• Federal Contaminated Sites Receiving Funds
  The Federal government announced that it will provide funds to assess the condition of suspected sites, perform necessary care and maintenance activities, and develop and implement a long-term strategy to address identified contamination.
  
  Examples of sites receiving substantial funding this year include the following:
  
  
  • Faro Mine, Yukon: Faro is the largest and highest priority of the federal contaminated sites. This site will be receiving $14.6 million in funding this year. Remediation planning is a priority at this site. Care and maintenance activities include on-going water treatment operations and maintaining infrastructure.
  • CFB Esquimalt: six sites will be receiving $4.56 million funding this year. Work at these sites includes remediation of hydrocarbon and heavy metal contaminated soil, assessment, and risk management. In addition, close to $200,000 has been provided to conduct assessments of sediment transport in Esquimalt harbour.
  • Port Radium Mine, NT: this site will be receiving $7.1 million funding this year. Site remediation is planned to start in the winter of 2007 and will include sealing of mine openings, covering of areas of elevated radiation levels, the stabilization of tailings areas, demolition and hazardous waste disposal.
  • Belleville Small Craft Harbour, Ontario: This site will be receiving $6.8 million this year to treat contaminated soil and prevent contaminants in groundwater from discharging into the adjacent Bay of Quinte. Belleville Harbour was used for over 50 years for the storage of coal and fuel products and landfill sites. These activities led to contamination of the property by petroleum hydrocarbons and heavy metals.

• ECO Canada - Who Will Do the Cleanup?
  According to a new report by ECO Canada, over 14,000 full-time site positions on contaminated sites projects will need to be filled between 2006 and 2009. On an annual basis, 3,500 new positions are expected to become available.

Alberta

• Province Requires Professional Involvement in Land Remediation and Reclamation Work
  Albertans can be assured that all land remediation and reclamation is completed to the same high standard of excellence. Since January 1, members of six professional organizations must be involved in, and sign-off on, all land remediation and reclamation work for oil and gas reclamation certificates. To support professional sign-off, a Joint Practice Standard has been developed by six professional regulatory organizations in consultation with the Alberta government.
  
  Alberta's Environmental Protection and Enhancement Act requires operators to conserve and reclaim specified land and obtain a reclamation certificate. To obtain a reclamation certificate, the site must be assessed for contamination and cleaned up to meet Alberta Environment's standards, the soil replaced and the site revegetated. These certificates are issued to operators when their site has been successfully reclaimed.
  
  The six professional organizations account for more than 50,000 professionals within Alberta, from agrologists and biologists to engineers and geoscientists to foresters. More than 6,000 of those licenced professionals responsible for environmental work are collaborating to ensure continued public safety with respect to the reclamation and remediation of sites in Alberta.

• New Requirement for Summary of Site Condition with Submissions for Ministry Review
  The Ministry now requests that applicants include a completed SoSC form with all service applications submitted for contaminated sites legal instruments and other services outlined in section 7.1 of the Contaminated Sites Regulation. Note that fees for review of the SoSC are not currently required for applications submitted for ministry review.

Manitoba

• Manitoba Minister Accepts Auditor General's Report into Contaminated Sites, Landfills
  November 7, 2007 - Conservation Minister Stan Struthers accepted the auditor general's report on the audit of Manitoba Conservation's management of contaminated sites and landfills, and announced that Manitoba will ensure proper permitting and licensing of all of the province's landfills.
  
  The report acknowledges the action taken since the auditor's last contaminated sites report in 2005. It also recognizes the progress of the government's accounting for the liability of contaminated sites. However, the auditor general's report provided 55 recommendations to help strengthen management of contaminated sites and landfills.
  
  The minister announced further action to address recommendations relating to landfills and contaminated sites.

• Brownfields Ontario Update
  Here are some of 2007's achievements:
  
  
  • Intergovernmental Forum on Brownfields
    Senior government staff from across Canada are moving forward to establish the Intergovernmental Forum on Brownfields. Ontario is pleased to be part of this initiative and hopes to see the participation of all provinces and territories.
    
    
  • Proposed Update in Standards
    On March 23, 2007, the Ministry of the Environment initiated a 60-day public consultation on a proposal to update the brownfield soil and ground water standards. The Ministry has been working with stakeholders to address issues raised since the proposed standards were released last spring.

  • Implementing Regulatory Reforms for Off-Site Liability Protection and the Record of Site Condition Review Process
    The Ministry of the Environment is working on regulations to implement the brownfield legislative reforms announced last spring.

  • Canada-Ontario Affordable Housing Program - Brownfields Initiative
    The Canada-Ontario Affordable Housing Program is funding eight affordable housing projects to be built on cleaned-up brownfield sites in the cities of Brantford, Cambridge, Ottawa, St. Catharines and Woodstock. This will help address the lack of affordable housing in older urban areas.
    The Canada-Ontario Affordable Housing Program involves a commitment of $301 million each from the federal and provincial governments. Together with municipal governments, at least $734 million will be invested in the program to provide affordable housing for 20,000 households in Ontario.
    
    
  • A Practical Guide to Brownfield Redevelopment in Ontario
    The guide has been developed for professionals, municipal leaders, environmental practitioners and others in the environmental or development field. It provides an overview of the benefits of brownfield redevelopment and the process for remediation and redevelopment in Ontario. The guide is easy to follow and includes useful tips, resources and practical information on how to get started.

• Brownfields Regulation - Qualified Persons
  The Ontario Ministry of the Environment is proposing to amend Ontario Regulation 153/04 made under the Environmental Protection Act (EPA) to change the provisions in section 5 regarding qualified persons who conduct or supervise environmental site assessments and who make certifications in records of site condition (RSCs) filed to the Brownfield Environmental Site Registry (Registry). Section 5 currently has a sunset date of April 1, 2008. Section 6, regarding qualified persons who may conduct risk assessments, would be unaffected by this proposal.
  
  The Ministry of the Environment is proposing the following amendments to section 5:
  
  
  1. As of April 1, 2008 amend the qualifications to be a qualified person to permanently include:
     • persons holding a limited licence under the Professional Engineers Act;
     • persons holding a certificate of registration under the Professional Geoscientists Act, 2000 who are limited members of the Association of Professional Geoscientists of Ontario;
  2. Provisions to allow all persons who are currently recognized as qualified persons to continue to work as qualified persons until March 31, 2009;
  3. Provisions to allow persons who are currently recognized as qualified persons and are licenced under the Professional Engineers Act or the Professional Geoscientists Act, 2000 to continue to be recognized as qualified persons indefinitely;
  4. Prescribe a purpose for the Registry that includes facilitating public access to information respecting qualified persons.

• Importation of Inert Fill for the Purpose of Rehabilitation
  Minor changes are being proposed to Policy A.R. 6.00.03 regarding the Importation of Inert Fill for the Purpose of Rehabilitation. The Policies and Procedures Manual is intended to assist Ministry of Natural Resources staff who are directly involved with the implementation and enforcement of the Aggregate Resources Act (ARA) and the regulations including the Aggregate Resources of Ontario Provincial Standards.
  
  The current policy requires inert fill to meet criteria in Table 1 of Soil, Ground Water and Sediment Standards for Use under Part XV.1 of the Environment Protection Act.

Quebec

• Update on Quebec's ClimatSol Program (2007-2010)

  ClimatSol Objectives:
  
  • Rehabilitate contaminated sites;
  • Integrate green technologies to construction projects;
  • Maintain or create wooden or "green" surfaces;
  • Densify and reinforce the urban fabric;
  • Promote use of treatment technologies for the decontamination of soil and groundwater;
  • Increase economic activity, increase municipalities income, foster job creation.
  
  ClimatSol/ReviSols differences:
  
  • Polluters and promoters who bought the land from polluters after 2003 are not eligible
  • Grants amount have been reduced to 50/30 %
  • Compulsory for projects to include the two following "climate changes" related aspects:
    • Buildings engineered to provide a reduction of energy consumption (NovoClimat, Leeds certification, etc)
    • Parks or buildings adding to "greenness"
      • No net vegetation lost
      • + 25 % of green cover for parks
      • + 10 % of green cover on build land (either through trees or green roofs)
  • Another selection will be made down the line based on the following elements (selection grid):
    • Reduction of the environmental impacts (35%)
      • Contamination level
      • Toxicity
      • Mobility
    • Smart Growth elements (35%)
      • Public transportation
      • Impacts on water pipes, sewers, roads
      • Energy consumption reduction
      • "Greening", etc.
    • Economic impacts (30%)
  • 1 million $ cap / project
